Very good article. I have gone through this process several times as a property manager in Toronto. I think a few things that should probably have been included here are:
1. The critical importance of detailed documentation. The more the better and as much as possible including names, dates, times, witnesses and exactly what transpired in the documented event.
– witnesses can be subpoenaed to testify at the tribunal
– video evidence may help but I find that tribunal adjudicators have little patience for this
2. Get a good para-legal to represent you at the hearing.
– if you don’t have in-house legal counsel, then hire one. do not go into the hearing alone.
3. Attempt mediation first.
– try and get your tenant to agree to move out in mediation
– depending on the severity of the situation, it may be beneficial to pay the tenant to move out
– try to offer this in mediation if you don’t have a rock-solid case for the hearing proper
